SekurMailEnd User License Agreement
This End User License Agreement (“EULA”) is between you and Intellect Service Consulting Company (McKinney, Texas, USA — “SekurMail,” “we”). It covers the downloadable SekurMail applications — iOS, Android, the browser extension, and any desktop client (the “Software”). The SekurMail web app and the Service generally are governed by the Terms of Service; this EULA supplements those Terms for the licensed Software, and controls for the Software specifically if they conflict. By installing or using the Software, you agree to this EULA. If you do not agree, do not install or use the Software.
1. License grant
We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software on devices you own or control, solely to access the Service in accordance with the Terms of Service and Acceptable Use Policy. All rights not expressly granted are reserved.
2. Restrictions
You may not: (a) copy, modify, or create derivative works of the Software except as allowed by law; (b) reverse-engineer, decompile, or disassemble the Software, except to the limited extent applicable law permits notwithstanding this restriction and not to circumvent security; (c) rent, lease, lend, sell, sublicense, or distribute the Software; (d) remove or alter proprietary notices; (e) use the Software to build a competing product; or (f) circumvent, disable, or interfere with security or license features.
3. Encryption and your keys
The Software performs end-to-end encryption on your device. Your private keys are generated and stored on your device and are never sent to us in any form we can open (during device linking, an encrypted key bundle only your devices can open may transit our servers). If you lose access to your keys (and any backup or unlock secret), the associated data cannot be recovered by us or anyone — this is inherent to end-to-end encryption. You are responsible for safeguarding your device, passphrase/unlock secret, and any biometric unlock you enable (see the Biometric Consent Notice).
4. Updates
The Software may download and install updates automatically to maintain security and functionality. You consent to these updates. We may discontinue support for older versions.
5. Third-party stores and terms
If you obtained the Software through the Apple App Store or Google Play, you also agree to that store's terms. Apple-specific terms (App Store): this EULA is between you and SekurMail only, not Apple; Apple has no obligation to furnish maintenance or support; in the event of a failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation; Apple is not responsible for product-liability, IP, or consumer-protection claims regarding the Software; and Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it.
6. Export and sanctions compliance
The Software contains encryption and is subject to U.S. export-control and sanctions laws. You represent that you are not located in an embargoed country, are not on a restricted-party list, and will not export or use the Software in violation of applicable law.
7. Warranty disclaimer; limitation of liability
The Software is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, to the maximum extent permitted by law. Our total liability relating to the Software is limited as set out in the Terms of Service (the greater of fees you paid in the trailing 12 months or US$100), and we are not liable for indirect, incidental, consequential, special, or punitive damages. Some jurisdictions do not allow certain exclusions, so parts may not apply to you.
8. Termination
This license terminates automatically if you breach it, and we may suspend or terminate as described in the Terms of Service. On termination you must stop using and delete the Software. Sections that by their nature should survive (2, 3, 6, 7, 9) survive.
9. Governing law and disputes
This EULA is governed by the laws of the State of Texas (and applicable U.S. federal law), and the binding individual arbitration, class-action waiver, and venue provisions of the Terms of Service apply to disputes under this EULA.
